The New-York based advocacy group Children’s Rights has filed a class action lawsuit against Massachusetts Department of Children and Families. The lawsuit charges the Department with violating the constitutional rights of children by routinely placing them in dangeous and unstable situations once removed from their parent’s care.
The case was in limbo well a federal judged ruled whether or not the class action lawsuit could proceed. According to this Boston Herald article,the judge ruled in favor of Children’s Rights and the lawsuit will continue.
Children’s Rights says they are filing this lawsuit on behalf of the 8,500 children in the system. It is unclear at this time what this might do to Massachusetts foster care system, but the Massachusetts Department of Children and Families said the lawsuit will force them to spend scarce dollars defending themselves in court.
